GA State Rep.: There’s No Such Thing as a Rape Victim | Democratic Legislative Campaign Committee

U.S. House Republicans have received a great deal of attention over the past week since seeking to qualify the crime of rape with the term “forcible” in a high-profile piece of legislation. Such a distinction could create classes of rape victims, with “forcible rape” victims somehow being ordained as worse off than victims of statutory rape, date rape, rape by coercion or deception, rape of the disabled or mentally impaired… You get the picture.

But what if rape victims could no longer be referred to as “victims” at all? What if people who have endured this horrible – and already chronically underreported -- crime could only be called “accusers”?

Georgia Republican state Rep. Bobby Franklin (of gold-standard-wannabe fame) has introduced a bill to change the state’s criminal codes so that in “criminal law and criminal procedure” (read: in court), victims of rape, stalking, and family violence could only be referred to as “accusers” until the defendant has been convicted.

Burglary victims are still victims. Assault victims are still victims. Fraud victims are still victims. But if you have the misfortune to suffer a rape, or if you are beaten by a domestic partner, or if you are stalked, Rep. Franklin doesn’t think you’ve been victimized. He says you’re an accuser until the courts have determined otherwise.

To diminish a victim’s ordeal by branding him/her an accuser essentially questions whether the crime committed against the victim is a crime at all. Robbery, assault, and fraud are all real crimes with real victims, the Republican asserts with this bill.

Rep. Franklin surely is aware that the crimes for which he believes there are no victims are disproportionately committed against women—and are disproportionately committed by men.

When there’s violence against women involved, the rights of the accused clearly are more important to Rep. Franklin than the rights of the victim.

But if there’s no such thing as a victim in cases of rape, stalking, and domestic violence, he may think there’s no need to for him to be concerned with their rights, anyway.

The New Face of Revolution: After Tunisia and Egypt, the World | CommonDreams.org

Sound familiar?

Coverage by U.S. state-controlled media of the revolutions in Tunisia and Egypt is too dim by half: they say it's an Arab thing. So it is. But not for long. The problems that triggered the latest uprisings, rising inequality of income, frozen credit markets, along with totally unresponsive government, span the globe. To be sure, the first past-due regimes to be overthrown may be the most brutal U.S. client states--Arab states such as Yemen, Jordan and Algeria. Central Asia's autocrats, also corrupted by the U.S., can't be far behind; Uzbekistan's Islam Karimov, who likes to boil his dissidents to death, would be my first bet. But this won't stop in Asia. Persistent unemployment, unresponsive and repressive governments exist in Europe and yes, here in the U.S. They are unstable. The pressure is building. creative commons photo via freestylee

Global revolution is imminent.

The first great wave of revolutions from 1793 through 1848 was a response to the decline of feudal agrarianism. (Like progressive historians, I don't consider the 1775-1781 war of American independence to be a true revolution. Because it didn't result in a radical reshuffling of classes, it was little more than a bunch of rich tax cheats getting theirs.)

During the 19th century European elites saw the rise of industrial capitalism as a chance to stack the cards in their favor, paying slave wages for backbreaking work. Workers organized and formed a proletariat that rejected this lopsided arrangement. They rose up. They formed unions. By the middle of the 20th century, a rough equilibrium had been established between labor and management in the U.S. and other industrialized nations. Three generations of autoworkers earned enough to send their children to college.

Now Detroit is a ghost town.

The uprisings we are witnessing today have their roots in the decline of industrial production that began 60 years ago. As in the early 1800s the economic order has been reshuffled. Ports, factories and the stores that serviced them have shut down. Thanks to globalization, industrial production has been deprofessionalized, shrunken, and outsourced to the impoverished Third World. The result, in Western countries, is a hollowed-out middle class--undermining the foundation of political stability in post-feudal societies.

In the former First World industry was supplanted by the knowledge economy. Rather than bring the global economy in for a soft landing after the collapse of industrial capitalism by using the rising information sector to spread wealth, the ruling classes chose to do what they always do: they exploited the situation for short-term gain, grabbing whatever they could for themselves. During the '70s and '80s they broke the unions. (Which is one reason average family income has steadily declined since 1968.) They gouged consumers in the '90s and '00s. (Now their credit cards are maxed out.) Now the banks are looting the government.

Now that the bill is due, they want us to pay. But we can't. We won't.

It's bad enough during a cyclical recession, when millions of Americans are losing their jobs and getting evicted from their homes. When the government's response to an economic holocaust is not to help these poor people, but instead to dole out hundreds of billions of dollars to the giant banks and insurance companies causing the firings and carrying out the foreclosures, it's crazy.

And when the media tells the one in four adults who is "structurally" (i.e. permanently) unemployed that he and she doesn't exist--the recession is over! recovery is underway!--it's obvious that the U.S. is cruising for revolution. Not the Tea Party kind, with corny flags and silly hats.

Late last year I wrote a book, The Anti-American Manifesto, which calls for Americans to revolt against our out-of-control plutocracy and the corrupt political biarchy that props it up. I expected the Right to react with outrage. To the contrary. While the desire for revolution is hardly universal among Americans, it is widespread and distributed across the political spectrum. Revolution, when it occurs here, will be surprisingly popular.

Criticism of my Manifesto centers not on its thesis that the status quo is unsustainable and ought to go, but on my departure from traditional Marxist doctrine. Old-school lefties say you can't (or shouldn't) have revolution without first building a broad-based popular revolutionary movement.

"We are still in a time and place where we can and should be doing more to build popular movements that can liberate people's consciousnesses and win reforms necessary to lay the foundation for a transformed society without it being soaked in blood," Michael McGehee wrote in Z magazine. "All this talk about throwing bricks and Molotov cocktails is extremely premature and reckless..."

Maybe that used to be true. I think things have changed. Given the demoralized state of dissent in the United States since the 1960s and the co-opting of radical activists by the cult of militant pacifism, it would be impossible to create such an organization.

As I argue in the book, anyone who participates in the Official Left as it exists today--the MoveOns, Michael Moores, Green Party, etc.--is inherently discredited in the current, rapidly radicalizing political environment. Old-fashioned liberals can't really help, they can't really fight, not if they want to maintain their pathetic positions--so they don't really try. America's future revolutionaries--the newly homeless, the illegally dispossessed, people bankrupted by the healthcare industry--can only view the impotent Official Left with contempt.

Revolution will come. When it does, as it did in Tunisia and Egypt, it will follow a spontaneous explosion of long pent-up social and economic forces. We will not need the old parties and progressive groups to lead us. Which is good, because they aren't psychologically conditioned to create revolution or midwife it when it occurs. New formations will emerge from the chaos. They will create the new order.

In my Manifesto I argue that old-fashioned ideologies are obsolete. Left, Right, Whoever must and will form alliances of convenience to overthrow the existing regime. The leftist critic Ernesto Aguilar is typical of those who take issue with me, complaining that "merging groups with different political goals around an agenda that does not speak openly to those goals, or worse no politics at all, is bound for failure."

The revolutions in Tunisia and Egypt may well be destined for failure--but it doesn't look that way now. So far those popular insurrections have played out exactly the way I predict it will, and must, here in the United States: set off by unpredictable events, formed by the people themselves, as the result of spontaneous passion rather than organized mobilization.

In Egypt, an ad hoc coalition composed of ideologically disparate groups (the Muslim Brotherhood, secular parties, independent intellectuals), has coalesced around Mohamed ElBaradei. "Here you will see extremists, moderates, Christians, Muslims, all kinds of people. It is the first time that we are all together since the revolution of Saad Zaghloul," a rebel named Naguib, referring to the leader of the 1919 revolution against the British, told Agence France-Press. ElBaradei's popularity, said Tewfik Aclimandos of the College de France, is due to the fact that "he is not compromised by the regime; he has integrity."

This is how it will go in Greece, Portugal, England, and--someday--here. There is no need to organize or plan. Scheming won't make any difference. Just get ready to recognize revolution when it occurs, then drop what you're doing and then organize.

What will set off the next American Revolution? I don't know. Nevertheless, the liberation of the long-oppressed peoples of the United States, and the citizens of nations victimized by its foreign policy, is inevitable.

Kolin: How the US Became a Police State | Informed Comment

To understand how the U.S. government became a police state, look no further than how it freed itself from colonial rule. For the American Revolution was, by and large, the result of a mobilization of the masses by the elites to liberate the colonized from a colonizer. It was the starting point of the myth of how the post- Revolutionary government would embody democracy.

The truth was that after the American Revolution, the thinking among economic and political elites was that America had become too democratic, especially as mass democracy expressed itself on the state level. The appearance and growth of democratic practices was perceived by elites as a threat to the expansion of state power. The government responded primarily through the use of force and violence, seeking to extend control over people and territory within North America through genocidal and ethnocidal measures against American Indians. Slavery was increasing in importance to the economy, in service of the expansion of state power. It is no coincidence that American Indians and slaves were the earliest groups defined by the government as political outsiders. Groups depicted as enemies of the state throughout U.S. history and described as “others” served as a convenient justification to enlarge state power at the expense of democracy.

Organized labor, especially its more radical elements, also challenged elite rule in the nineteenth and twentieth centuries, and political repression was turned loose against them. In surveying U.S. history, it becomes clear that the actions of the government in the end were intended to disrupt and eliminate progressive, mass- based political movements. The state viewed labor organizations as political outsiders, seen as seeking to subvert the government by forming an alliance with external enemies of the United States. Whether applied to organized labor, Socialists, Communists or terrorists, state ideology remained the same in perceiving the threat as coming from political outsiders, hence the need to employ emergency measures.

As police states are, by their nature, hostile to rule of law, political repression is accomplished through the use of essentially illegal measures, such as the Alien and Sedition Acts and the Espionage Act. This outlawing of political thought and alternative viewpoints persists as an ongoing theme. From the 1920s onward, in order to combat political outsiders, many state governments formed a partnership with local police officials with the goal of stamping out grassroots democracy. These Red Squads, a political police force, engage in surveillance, disruption, and, in many instances, the destruction of political organizations active in nonviolent political expression. The Red Squads acted in similar ways to the FBI, as agents of the state seeking to instill in American society social and political conformity.

The development of other essentially political police agencies within the federal government, to supplement the work of the FBI, such as the CIA, NSA, and a host of other intelligence gatherers on the federal and state levels, were an ominous sign. State repression was accelerating during the Truman administration with the passage of the National Security Act, and the growth of the CIA. Inside the federal government, there was an increasing subordination of the legislative branch to the executive branch., concentrating power in the context of a permanent emergency——and causing the government to become more determined to eliminate mass democracy. For instance, during World War II and in the name of a national emergency, Roosevelt ordered the internment of Japanese American citizens. This targeting of outsiders identified as an internal and external threat, continues to the present day; the alleged menace, was first Communism, and later, terrorism.

While mass democracy was being crushed in the United States, foreign policy in the postwar period remained consistent, extending control over more people and more territory, resulting in alliances with dictatorships so as to crush democracy overseas as well. After World War II, the military industrial complex became another key component in the twisted road to police state practices, based on the premise of permanent war making, with a cold war arms race, the sending of troops, and the establishment of military bases across the globe. This is another defining feature of a police state: a nation placed in an ongoing state of mobilization to prepare and fight wars throughout the globe. Police states, incorporate war-making into normalized state functions. Permanent war making translates into the global subversion of democracy. Supplementing the military in undermining democracy overseas, the CIA was one of many federal agencies during the second half of the twentieth century that was carrying out an essentially antidemocratic mission in the name of national security.

In assessing the successes and failures of progressive movements in the United States, in many ways, their limitations can be attributed to the intensive scale and scope of political repression, such as the FBI’s Cointelpro Program, which clearly diminished their effectiveness and in most cases, fundamentally undermined them. In many ways, Cointelpro was significant in paving the way for a police state, for progressive movements that developed after Cointelpro were much smaller and less effective in advancing mass democracy.

The ending of procedural democracy was yet another step toward the establishment of a permanent police state. The Constitution is supposed to place legal limits on the concentration of power within parts of government. Instead, with political repression of mass-based movements justified by declarations of national emergency, the government consistently stepped outside Constitutional legal boundaries. As a result, by the early 1970s, large- scale political movements were on the wane, in particular, as the events of Watergate unfolded, in many ways, a dress rehearsal for a police state. Watergate represented a political assault, not just on the supposed external threats to the Nixon administration, but political repression was extended to the government’s internal enemies. That meant taking action against the Democratic Party by seeking to rig an election, one of the most blatant attempts to destroy procedural democracy.

The concentration of power within one branch of government had been manifesting itself increasingly as an imperial presidency. Postwar presidential administrations define their power largely in relation to foreign policy initiatives. The foreign policies of post- Nixon administrations were outwardly anti- Communist and antiterrorist but in reality were driven by the maintenance and extension of a global American empire. Post-Watergate administrations were largely successful in finding various ways around the so- called Watergate reforms, seeking to enlarge the powers of presidents at home and overseas.

By the time we reach the presidency of George W. Bush, the executive branch had become a branch that saw itself as above the law while making law. The state came to embody the will of. Bush and his inner circle. The spark that ignited the transition toward the final form of an American police state was the attacks on the World Trade Towers in 1993 and 2001. In response, the government acted outside the Constitution by passing the Patriot Act, the Military Commissions Act, and other measures, producing a direct assault on civil liberties.

The clearest indication of American police state practices is the use of preventive detention. In one example—extraordinary rendition—all the government has to do is accuse anyone of anything related to terrorism, sufficient reason to seize and ship individuals elsewhere to be tortured.

The twisted and extensive use of signing statements also indicates that an administration is functioning outside the law. In a distorted extension of the theory of a unitary executive, President Bush’s excessive use of signing statements resulted in dictatorial powers.

What is the future of the American police state? If history tells us anything about police states, it is that they all eventually crumble, in large part, because over time, they become dysfunctional. The same can be said of the police state of the Bush administration. During the second term, there were indications of a breakdown in how this police state functioned. Some of the clearest symptoms of this dysfunction were the revelations of torture at Abu Ghraib, the National Security Agency’s surveillance program, and the large number of prisoners released from Guantanamo Bay. In addition, opposition mounted to the reauthorization of the Patriot Act and the Supreme Court ruling in the Boumediene case, which called into question the use of the Military Commissions Act. In the early days of the Obama administration, the trend seemed to point toward an American police state that will be modified, but not eliminated.

It was a lie.

"We are five days away from fundamentally transforming the United States of America," said Barack Obama shortly before the 2008 election. "I am absolutely certain," he had said in St. Paul when he clinched the Democratic nomination, "that generations from now, we will be able to look back and tell our children that this was the moment when we began to provide care for the sick and good jobs to the jobless; this was the moment when the rise of the oceans began to slow and our planet began to heal; this was the moment when we ended a war and secured our nation and restored our image as the last, best hope on earth."

In retrospect, that messianic fervor is shocking. Today no one can easily say who Barack Obama is or what he stands for; and the coming year is unlikely to offer many clues, since all the thoughts of Obama in 2011 appear to concern Obama in 2012. The best one can do is to point out that the words of his State of the Union address seem uttered by a different person and spoken in another language

NEW ORLEANS (CN) - A legal expert says aspects of BP's oil spill compensation fund made through its Gulf Coast Claims Center "do not comport with the usual standards for transparency and fairness." Kenneth Feinberg's law firm receives $850,000 a month while Feinberg oversees claims for BP. Tulane law professor Edward Sherman was hired by plaintiff counsel to determine whether the Gulf Coast Claims Facility is meeting expectations.
Sherman made the statement in a 5-page declaration submitted to U.S. District Judge Carl Barbier, who is hearing the consolidated complaints stemming from the Deepwater Horizon catastrophe.
Sherman wrote that a claims center should be established with standards of "independence, neutrality, and experience," should adhere to judicial supervision, and should be transparent about where its funding comes from.
Claimants should be told Feinberg was hired by and is paid through BP, Sherman wrote. He says this would help claimants determine for themselves whether Feinberg's statement that claimants are better off not litigating may be influenced by Feinberg's contract with BP.
Sherman's 5e-page statement is followed by an 11-page Curriculum Vitae that lists his legal expertise, including his former position as Dean of Tulane Law School, a teaching fellowship at Harvard Law, his alma mater, and an extensive list of publications, including casebooks for law schools. His experience included complex litigation, civil procedure and alternative dispute resolution. He has served as counsel, consulted with counsel, or served as an expert witness in a large number of class actions and complex litigations in federal and state courts.
Sherman claims the monthly $850,000 "fee arrangement" between BP and Feinberg's law firm, Feinberg Rozen LP, "contrasts with the usual method of payment of special masters, who are paid on an hourly basis according to the prevailing market rates in the community."
